What is the process for filing a divorce in Ontario? 

Filing for divorce requires submitting a divorce application to the court. The basic steps include:

  • Completing the necessary court forms based on your circumstances (e.g., custody, support, or property division).

  • Paying the court filing fees.

  • Officially serving your spouse with the divorce documents as per Ontario’s legal requirements.

How long does a divorce take to finalize?

The timeline depends on the complexity of the case. Some key factors that affect the speed of the process include:

  • Whether both spouses agree on key issues like child custody, support, and asset division.

  • The time needed to prove one of the legal grounds for divorce.

  • Court scheduling delays, which vary by location.

If everything is uncontested, a divorce order can be granted in a few months. However, if disputes arise, it could take a year or more to finalize.

Do I need a specific reason to file for divorce?

No, Canada follows no-fault divorce laws, meaning you don’t have to prove your spouse did anything wrong. However, you must meet at least one of these three conditions:

  • Living apart for at least one year (this is the most common reason).

  • Adultery, which must be proven, including the identity of the person involved.

  • Cruelty, where one spouse has been physically or emotionally abusive to the other.
